    1. Introduction

      This policy specifically outlines GreenSlate, LLC’s, together with Green 16, LLC, and all our subsidiaries and affiliates (“GreenSlate”, “we”, “us”, and “our”) Privacy Policy for its Websites and App (“Online Privacy Policy”). We respect Your privacy and are committed to protecting the personal information that You may share with us.

      This Online Privacy Policy applies to all visitors and users of our Websites and App.

      By continuing to visit and use our Websites and App, You are agreeing to the terms of this Online Privacy Policy. If You do not agree, then please exit this Website and/or Application and close Your browser.

    2. Definitions

      “Consumer” means a natural person that visits our Website, but is not a Production Associate.

      “GreenSlate Job Applicant” means a natural person that applies for a job with GreenSlate directly, and is not applying for a job with a Production.

      “Personal Information” means any information relating to an identified or identifiable individual that is collected via our Website and Apps. Personal Information may include a Production Associate’s or a Consumer’s: full name, physical address, email address, IP address, or other identifier such as from a Cookie.

      Personal Information does not include any aggregate or anonymized data that may have been created from Personal Information but can no longer be used to identify, relate to, or could reasonably be linked to a Consumer or a Production Associate.

      “Production” means a film or other media project being run by a studio or production company.

      “Production Job Applicant” means a natural person who has submitted their resume for consideration to be hired by a Production.

      “Production Associate” means a natural person who has been hired to work on a Production.

      “Sensitive Personal Information” means any data about a natural person that reveals a racial or ethnic origin, political opinion, religious belief, philosophical belief or trade union membership. It also includes a natural person’s genetic and biometric data, social security number or driver’s license number, financial account information, and data concerning their health, sex life or sexual orientation.

      “You” or “Your” means a Consumer and a Production Associate.

      “Websites and App” means http://gslate.com , https://info.gslate.com/production-accountants?openings , https://app.gslate.com and https://demo.gslate.com.

    3. Information that We Collect from You when You visit Our Website and Apps

      We collect certain Personal Information from You in order to operate our Websites and App effectively and provide You with the best experiences when You visit and use them.

      1. Information Provided by You

        If You are a Production Associate, and You register for an account online with us or download our application, we will collect certain personal information from You such as Your name, address, e-mail address, and telephone number, and possibly, employer name. Additionally, if You are a Production Associate, we may need to collect additional Personal Information about You in connection with Your employment with a Production, including Your Sensitive Personal Information. For more information about our privacy practices with regards to Production Associates, You can find our Production Associate Privacy Policy here: Associate Privacy Policy. Please note that only Production Associates and members of the Productions can register for an account online with us and use our application.

        If You are a Consumer just visiting our Website, or You work for a Production and are interested in our services, a Production Job Applicant or otherwise hoping to become a Production Associate and looking for more information, we will collect certain Personal Information about You, such as Your name, Your employer’s name and email address, when You fill out a contact form, sign up for job alerts, or fill out a subscription form for our newsletter.

        If You are a GreenSlate Job Applicant, we will collect Your Personal Information (such as Your name, address, email address, and employment information) and possibly Your Sensitive Information (such as Your race and possibly, union membership).

      2. Information collected on Our Websites and App

        We also may use various technologies to collect information from Your computer or device, and about Your activities on our Websites or App.

        1. Information collected automatically:

          We may automatically collect information from You when You visit Our Websites and App. This information may include Your IP address, location data, Your browser type and language, access times, the content of any undeleted cookies that Your browser previously accepted from us, referring or exit website address, internet service provider, date/time stamp, operating system, locale and language preferences, and system configuration information.

          We also use HubSpot to collect information about Your use of our Websites and App as well, and organize Your contact information and help us with our marketing activities.         2. Cookies:

          When You visit our Websites and/or App, we may assign Your device one or more cookies to facilitate access to our site and to personalize Your online experience. Through the use of a cookie, we also may automatically collect information about Your online activity on our site, such as the web pages You visit, the links you click, and the searches You conduct on our site. Most browsers automatically accept cookies, but You can usually modify your browser setting to decline cookies.

          A cookie is a small text file that is stored on a user’s computer for record keeping purposes. Cookies can be either session cookies or persistent cookies. A session cookie expires when you close your browser and is used to make it easier for you to navigate our website. A persistent cookie remains on your hard drive for an extended period of time.

          We use cookies to personalize content and ads, to provide social media features and to analyze our traffic. We also share information about Your use of our site with our social media, advertising and analytics partners, who may combine it with other information that You’ve provided to them or that they’ve collected from Your use of their services.

          When you first visit our site, we provide You with a choice to either accept or deny certain cookies. If You choose to decline cookies please note that some of the features and services of our Websites and/or App may not function as well as intended. Even if You choose to accept cookies, You are always free to change Your mind and revoke that consent.

        3. Other technologies:

          We may use standard Internet technology, such as web beacons and other similar technologies, to track your use of our Websites and Apps. We also may include web beacons in promotional e-mail messages or newsletters to determine whether messages have been opened and acted upon. The information we obtain in this manner enables us to customize the services we offer to users of our Websites and Apps to deliver targeted advertisements and to measure the overall effectiveness of our online advertising, content, programming, or other activities. Web beacons (also known as clear gifs, pixel tags or web bugs) are tiny graphics with a unique identifier, similar in function to cookies, and are used to track the online movements of web users or to access cookies. Unlike cookies, which are stored on your device, web beacons are embedded invisibly on the web pages (or in emails) and are about the size of the period at the end of this sentence. We also may receive an anonymous identification number if you come to our Website or App from an online advertisement displayed on a third-party website.

    4. Why We Collect Your Information
      1. To Service Our Website and Apps

        We use information collected to ensure that Our Website and Apps are working as intended and for analytics purposes, to understand how our Website and App are operating and learn how they can be improved. We also use this information as needed for auditing purposes as well.

      2. For Marketing Purposes

        If You have filled out a contact form with us, signed up for Our Newsletter or to receive job alters from us, We may use this information to send You marketing communications including other newsletters and emails. You can opt out of receiving these communications at any time by clicking the “opt out” link at the bottom of these emails or by emailing us directly at privacy@gslate.com.

      3. To Evaluate and Improve our Customer Service

        We may use this information to ensure we are providing the highest level of customer service, and to identify any potential gaps or potential improvements to the same.

      4. In Order to Provide our Services

        If You are a Production Associate or a Production Job Applicant, we only use Your information to provide our Services to Productions, which if You are a Production Job Applicant, may include sharing Your resume as You have directed via our resume upload service. Please note that all hiring decisions, including vetting You as a candidate, is solely the decision of the Production and we just provide the portal enabling You to upload Your resume.

      5. In Order to Respond from Requests from You

        If You have requested further information or in any other way requested that we contact You, We will use Your Personal Information to respond to such a request.

      6. For Our Legal Purposes

        We also collect information in order to comply with certain legal rules and regulations that we are subject to.

    5. How Long do We Store and Maintain Your Personal Information?

      We only store and maintain Your Personal Information for as long as is necessary to fulfill the purpose for which it was collected. For example, if You sign up to receive Our newsletters or to receive job alerts, we will store and maintain Your Personal Information to continue to send You these materials until You opt out of receiving such communications. With regards to Your Personal Information collected for our analytics purposes and used to help maintain and improve our Websites and App, we only store and maintain that information until it is aggregated and used to create a new anonymous data set that no longer contains Your Personal Information, and then delete the underlying Personal Information once that new data set has been created. If You are an Production Associate, we may need to maintain Your information longer as per legal obligations, as is outlined in our Production Associate Privacy Policy which can be found: Associate Privacy Policy.

    6. We do not Sell Your Personal Information

      GreenSlate does not under any circumstances sell any Personal Information that it has collected via Our Websites and App to any third parties.

    7. Who do We share Collected Personal Information with?

      GreenSlate only shares Your Personal Information when necessary to members of our internal team and with our service providers.

      GreenSlate uses services from selected service providers and, when necessary to share Your Personal Information with such service providers, ensures that they are contractually obligated to secure Your Personal Information in the same way that we do and further that they cannot sell or further share Your Personal Information without consent.

      Specifically, the third parties service providers that We may share Your Personal Information with are:

      • IT service providers for hosting, management of IT systems, backup, provision and maintenance of IT networks, backup networks, etc.; and
      • Service providers for archiving, etc.

      Depending on the need, we may also have to share Your Personal Information with:

      • Our Legal Representatives;
      • Parties that have provided a valid legal demand entitling them to obtain such information, such as a subpoena or court order; and
      • Authorized third parties such as Law Enforcement, Courts, Supervisory Authorities and Auditors.
    8. How do We Secure Your Personal Information?

      GreenSlate maintains a comprehensive Information Security Program that employs commercially available physical and IT securitization tools, including but not limited to:

      • Commercially available and sufficient firewalls;
      • Segmented Data Storage;
      • Multi-factor authentication;
      • Industry-standard SSL-encryption to enhance the security of the data transmissions; and
      • Policies providing for least privileged access to data across our organization.
    9. California Residents Legal Disclosures

    1. Sale or sharing of the Personal Information and Sensitive Personal Information of Persons under the age of 16

      We do not collect, sell, or share the Personal Information of persons under 16 years of age on our Websites and App.

      The only exception to this would be if a Production Associate is a validly hired child actor and under the age of 16, but in that situation we follow all related rules and legal obligations with regards to the collection and processing of that child actor’s Personal Information and Sensitive Personal Information, as is outlined in our Production Associate Privacy Policy, which can be found here: Associate Privacy Policy.

    2. Use and Disclosure of Sensitive Personal Information

      We do not collect or disclose the Sensitive Personal Information of Consumers.

      If You are a GreenSlate Job Applicant, we may need to collect some of Your Sensitive Personal Information in order to process Your application, but we do not use it for any other purpose besides than to vet You as a potential employee and if you are hired, then to support and enable Your employment. If You are a Production Job Applicant, we only collect Your resume or other application materials that may contain Your Personal Information and/or Your Sensitive Personal Information and disclose the same with a Production as You have requested. If You are a Production Associate, we only collect and use Your Sensitive Personal Information to facilitate and support Your employment with a Production and for our business purposes, as outlined in our Production Associate Privacy Policy, which can be found here: Associate Privacy Policy.

    3. Sale or sharing of Your Personal Information for Our Business Purposes

      As noted above, we do not sell Your Personal Information nor do we share it for cross-context behavioral advertising. We do need to otherwise share Your Personal Information with third parties for our business purposes, as noted above. We do not share Your Personal Information for any other reason besides for our business purposes.

    1. Why We Collect this information from You

      We use this information from You to support and run our Websites and App, to facilitate Your application for employment, and for our business purposes as outlined above in Section IV.

    2. Categories of Personal Information that we share for Our Business Purposes:
      • As noted above, if You are a GreenSlate Job Applicant we may share Your Personal Information and Sensitive Personal Information as needed in order to support and facilitate Your application for employment with us, and for our business purposes. If You are a Consumer, we collect and share Your Personal Information for our business purposes. Specifically, these categories of business purposes are:
        1. Auditing – We may share this information with our third-party vendors, partners and service providers, and our own auditors related to an audit of our business.

        2. Service Improvements – We may share this information with our third-party vendors, other partners, and service providers in order to improve Our services, create new services and products, offer new products, and to ensure that Our services are working as intended (to identify bugs and errors, and repair them).

        3. Service Partners – We may share this information our third-party vendors, other partners, and service providers in order to have them perform their services for Us, pursuant to a written contract that includes the notified purposes permitted by California Law.

        4. Security and Legal Issues – We may share this information with law enforcement or other individuals pursuant to a valid subpoena or other legal obligation, our third-party vendors, other partners, and service providers in order to detect, prevent, and investigate security incidents.

    3. Your Rights under California Law:
      1. You, or Your authorized agent, can request the specific pieces of Personal Information we have collected about You by emailing privacy@gslate.com. You can also request that we disclose how we have collected, used and shared Your personal information over the past 12 months, including the categories of personal information we collected and our purposes for doing so. You may also request the categories of the sources of that information, the categories of the third parties with whom we have shared this information with for a business purpose, and our business purpose for doing so.

      2. You have the right to correct inaccurate Personal Information that we have collected or maintain about You. In fact, we ask that You do so as soon as You realize any Personal Information that we have collected is inaccurate as it could impact our provision of the Services.

      3. You have the right to opt out of Sale of Your Information, but as noted above, We do not sell Your information.

      4. You have a right to be notified when we collect information from You, and we cannot collect new categories of information from You without notifying You first.

      5. You have the right to limit our sharing of Your Personal Information.

      6. You have the right to not be discriminated against for exercising these rights.

      7. You have the right to ask us to delete Your Personal Information. Please note that if You are a GreenSlate Job Applicant and our collection of Your Personal Information and Sensitive Personal Information is done in connection with the provision of Your application for employment and eventually the provision of Your employment, then we must maintain certain information related to Your employment pursuant to various regulations. Thus, if You request that we delete Your Personal Information, we may not be able to so right away if subject to those legal requirements. However, as soon as we legally can delete your information we will.

    4. How to Exercise Your Rights

      If You would like to exercise any of the rights listed above with regards to Your Personal Information, then please contact Us, or have Your registered agent contact Us, at privacy@gslate.com.

      If you want to review and request changes to Your Personal Information, You may also email or call us as noted below, and we will then provide you with detailed instructions on how to do so.

    5. For EU Data Subjects – General Data Protection Regulation (Regulation (EU) 2016/679)(“GDPR”)
      1. What Information do we Collect from You if You are also EU Data Subjects?

        We collect the same Personal Information and Sensitive Personal Information (together, “Your Data”) from all Consumers, GreenSlate Job Applicants, Production Associates, and Production Job Applicants as outlined above. If You are a Production Associate working in the EU, then You can learn more about our Production Associate Privacy Policy which can be found here: Associate Privacy Policy.

      2. How do we collect Your Data?

        In the same manner as outlined above, which includes collected directly from You and via automated means.

      3. How will we use Your Data?

        We only use Your Data as outlined above, and only as necessary for the purposes upon which Your Data was collected.

      4. How do we store Your Data?

        We securely store Your Data as detailed above. We only store Your Data for as long as necessary to support and facilitate the reason for its collection and only as long as legally required and/or allowed. Once the legal requirement to store Your Data has expired, we securely delete it.

      5. What are Your Data Protection Rights?

        As an EU Data Subject, You have the following rights:

        1. The Right to Access Your Data - including asking for copies of Your Personal Information and Sensitive Personal Information. We are entitled to charge you a small fee to provide You with the same.

        2. The Right to Rectification of Your Data - including the right to ask us to correct any inaccurate data and complete any incomplete data.

        3. The Right to Erasure of Your Data - including asking us to delete copies of Your Data. Please note that we may not be able to immediately delete certain portions of Your Data based on legal rules and requirements, however, once those restrictions have expired, we will delete the same.

        4. The Right to Restrict Processing of Your Data – including the right to request that we restrict processing of Your Data under certain circumstances. Again, legal requirements and obligations may limit our ability to fully restrict the processing of Your Data.

        5. The Right to Object to the Processing of Your Data - including the right to request that we stop processing Your Data under certain circumstances. Again, legal requirements and obligations may limit our ability to fully stop processing of Your Data.

        6. The Right to Data Portability - including the right to request that we transfer Your Data to another organization or directly to You, under certain circumstances. Again, legal requirements and obligations may require us to also maintain copies of Your Data even if we transfer it as requested.

    1. Children’s Personal Information

      We do not knowingly collect personal information from children under the age of 16. Our services, Website and App are not marketed to or geared for children under the age of 16.

    2. Third-Party Tracking on Our Website and Apps

      Third-parties may be using Cookies or other technologies to collect Your personal information as You navigate through the internet including from our Website and App. As described above, You may decline these third-party Cookies by changing Your browser settings.

    3. Do Not Track (“DNT”) Settings

      DNT is a setting on some web browsers or mobile devices that can be turned on to instruct websites to disable tracking of your web browsing activities. DNT is not currently widely adopted and does not have clear standards or guidelines as to how websites are to interpret it. Additionally, its signals can affect the functioning of certain websites. As such, GreenSlate does not generally respond to these signals.

    4. Third Party Applications and Sites

      We may include or offer third party products or services on our Websites and App. Some of these third party sites may be co-branded with an GreenSlate logo, even though they are not operated or maintained by GreenSlate. Although we choose our business partners carefully, when You visit these third party sites and decide to share Your Personal Information with them, You are assuming the risk of doing so. GreenSlate is not responsible for nor assumes any liability for the privacy practices of websites operated by any third parties, including those that may be linked to our Websites and Apps, and including the content of those sites. You should check the applicable privacy notice and/or policy of the third party website or application to understand how it collects and manages any information they collect from you.

      As noted in our Terms of Service, GreenSlate does not endorse or control any other websites or applications besides Our Websites and App, nor does the act of providing a link to a third party website or application constitute an endorsement, promotion, or approval of such website or application or its content.

    5. Changes to this Online Privacy Policy

      Any changes to the Online Privacy Policy will be posted directly on our Websites and App and reflected with a new Effective Date at the top of this Online Privacy Policy. We encourage You to review the Online Privacy Policy each time You visit our Websites and App to see if it has been updated since Your last visit.
